CE marking for products in passive fire protection

What is CE marking

CE mark has two purposes:

  • promotion of free trade in goods within the EEA (European Economic Area)
  • harmonization of the legislation of the EEA countries for product safety and health

Products with CE mark can be freely traded throughout the EEA (EU Member States and Iceland, Liechtenstein and Norway). National governments may not impose additional requirements. Products that do not meet the EU requirements are not permitted to attach a CE mark and the products may not be marketed in the EEA.

CE marking is required if there is a hEN (harmonized European standard) for a particular product. You can search the current hEN standards: LINK

In the relevant hEN, please refer to the "scope" if it applies to your product. Attachment (Annex) ZA states all information regarding CE marking; how to label, what to test, and in which "level" is your product etc.

Under the CPR (Construction Products Regulation), from the 1st of July 2013, it is mandatory to attach CE marking to a product for which a hEN exists. For penetration- and joint seals no harmonized standard is available yet.

Voluntary CE marking

It is possible to obtain a CE mark for a product that is not yet covered by a hEN. That is based on an ETA (European Technical Assessment).

For example, for a type of collar a TAB (Technical Assessment Body) can issue an ETA.

ETA

The essential characteristics, as given below, are given in the ETA by the performance achieved:

  • Mechanical resistance and stability
  • Safety in case of fire
  • Hygiene, health and environment
  • Safety use
  • Protection against noise
  • Energy economy and heat retention
  • Sustainable use of natural resources

With regard to the requirement 'fire' for fire-resistant penetrations the ETAG 026-2 is used. That is a European Technical Approval Guideline, a document indicating how to meet the different requirements (essential characteristics). For example, fire-resistance is referred to the European test standard EN 1366-3.

CE marking on the basis of an ETA only applies to the manufacturer who has applied for and obtained the relevant ETA. The manufacturer shall state his contact details, the declared performance(s) and intended use of the product in the Declaration of Performance (DoP; Declaration of Performance). The DoP shall also mention the applied hEN or ETA.

Why voluntary CE marking?

ORYX® is part of a European organization and wants to lead in terms of regulation and European tested solutions. CE marked products are increasingly asked for. This is simply because 'construction products' in Europe must bear the CE mark when a hEN exists.

At this time, the hEN for penetration seals is not yet standardised, but it will be in the future.

Summary Regulation No. 305/2011

The rules of Member States require that construction works be designed and executed so as not to endanger the safety of persons, domestic animals or property nor damage the environment. Those rules have a direct influence on the requirements of construction products. Those requirements are consequently reflected in national product standards, national technical approvals and other national technical specifications and provisions related to construction products. Due to their disparity, those requirements hinder trade within the Union.

The last sentence indicates that national regulations are so diverse that it hindered trade within the Union. It is therefore controlled and regulated by the European Union to use European standards.
